2. What data we process

We process personal data that you provide to us yourself or that is automatically collected when using our webshop, including:

  • First and last name
  • Address details (billing and delivery address)
  • Email address
  • Phone number
  • Order and return history
  • Payment details (such as payment method; we do not receive full card details)
  • IP address and device data
  • Browser and session data
  • Website usage (e.g. pages viewed, click behaviour via cookies/analytics)

By-Men does not process special categories of data (such as health data, religion, citizen service number, or biometric data) and does not knowingly target children under the age of 16. If you suspect we have processed data from a minor, please contact us so we can delete it.

3. Purposes of processing

By-Men uses your data solely for legitimate purposes, such as:

  • Processing and delivering orders
  • Processing payments
  • Sending Track & Trace information and delivery updates
  • Creating and managing customer accounts
  • Customer service and answering questions
  • Automatic emails such as order confirmations, shipping updates, and review requests
  • Sending newsletters and offers (only with permission)
  • Analysis and improvement of our webshop and services
  • Compliance with legal obligations (such as tax retention obligations)

4. Basis for processing

We process personal data based on the following principles from the GDPR:

  • Execution of an agreement: to process and deliver your order.
  • Legal obligation: for example, tax retention of invoice data.
  • Consent: for newsletters and certain marketing cookies/tracking.
  • Legitimate interest: such as fraud prevention, customer service and limited analyses to improve our webshop.

5. Retention periods

We do not retain your data for longer than is necessary for the purposes for which it was collected, unless a longer retention period is required by law.

  • Order and invoice data: 7 years (tax retention obligation).
  • Customer accounts: as long as the account is active. We can delete or anonymize your account upon request.
  • Newsletter data: until you unsubscribe.

6. Sharing with third parties

We never sell your data to third parties. Data is only shared with parties necessary for our services or when legally required. This includes:

  • Shopify (the platform on which our webshop runs – hosting, order processing, database).
  • Mollie BV (our payment provider for iDEAL, Bancontact, credit card and other payment methods).
  • Payment methods via Mollie (such as iDEAL, Bancontact, Klarna, credit card, PayPal).
  • Shipping partners (such as PostNL, DHL, UPS or other carriers).
  • IT and hosting providers (security, backups, technical support).
  • Analytics and advertising partners (such as Google, Meta/Facebook, Instagram, TikTok).

We enter into data processing agreements with parties who process your data on our behalf (processors) in accordance with the GDPR. These parties act solely on our behalf and not for their own purposes.

If personal data is processed outside the EU/EEA, we only use parties that work with EU-approved Standard Contractual Clauses (SCCs) or equivalent safeguards, so that your data also remains protected internationally.

6A. Email Communications and Automation – Klaviyo

By-Men uses Klaviyo to securely send emails, such as order confirmations, shipping updates, review requests, and—with your permission—newsletters and offers.

The data shared with Klaviyo may include:

  • Email address
  • Name
  • Order information (e.g. order number, products, total amount)
  • Delivery status (such as 'shipped' or 'delivered')
  • Interaction data (such as whether an email was opened or clicked)

Klaviyo processes this data to send emails and create reports on behalf of By-Men. Data is not sold to third parties.

6B. Parcel tracking and delivery notifications – Parcel Panel

By-Men uses Parcel Panel for Track & Trace updates. This service allows you to track the status of your order and, if configured, receive notifications.

The data shared with Parcel Panel may include:

  • Name
  • Email address
  • Order number
  • Tracking number
  • Product information
  • Carrier status updates (such as processed, in transit, delivered)

Parcel Panel uses this data solely to display shipping status and, if applicable, send shipping notifications.

7. Cookies and tracking

Our webshop uses cookies for, among other things:

  • Functional operation (such as shopping cart, login status, language preferences)
  • Analysis and optimization of the webshop
  • Marketing and personalized advertising (only with permission)

On your first visit, we'll show you a cookie banner where you can set your preferences. Advertising platforms like TikTok, Meta, and Google only receive data for marketing purposes if you've given your consent.

8. Your rights (GDPR)

9. International customers and data transfers

By-Men applies the same privacy and security standards to customers both within and outside the European Union. Because we use international services (such as Shopify, Klaviyo, Google, Meta, and TikTok), personal data may be processed outside the EU/EEA.

In such cases, we ensure that your data is only passed on to parties that have taken appropriate safeguards, such as the Standard Contractual Clauses (SCCs) approved by the European Commission or equivalent safeguards.

10. Security

We take appropriate technical and organizational measures to prevent misuse, loss, unauthorized access, unwanted disclosure, and unauthorized modification. These include encrypted connections (SSL), secure systems, limited access rights, and the use of trusted processors.
