2. Applicability

  • These general terms and conditions apply to all offers, orders and agreements made through the By-Men webshop.
  • By placing an order the customer agrees to these terms and conditions.
  • Deviations are only valid if agreed in writing.

3. Conclusion of the agreement

  • The agreement is concluded when the customer places an order and receives an email confirmation.
  • An order is only final when payment has been successfully completed.
  • By-Men reserves the right to refuse orders if fraud or abuse is suspected.
  • If an order cannot be fulfilled, By-Men will inform the customer of this within 7 days.

4. Prices and payments

  • All prices are stated in euros, including VAT and excluding any surcharges, unless otherwise stated.
  • The applicable shipping costs (currently €0.00 within Europe) are stated during the ordering process.
  • Payment must be made in full via one of the offered payment methods.
  • Orders outside of Europe are currently not offered through By-Men.
  • Obvious errors or mistakes in prices do not bind By-Men.

5. Delivery and shipping

  • Orders are typically processed and shipped within 1–3 business days .
  • Average delivery time:
    • Netherlands & Belgium: 6–11 business days after dispatch
    • Other countries within Europe (such as Germany, Sweden and Denmark): 7–12 working days after dispatch
  • All orders within Europe are shipped free of charge.
  • Delivery times are indicative and do not entitle you to compensation, unless delivery is unreasonably delayed.
  • The risk of loss or damage to products passes to the customer upon delivery.
  • If delivery is delayed, the customer can notify By-Men in writing of the default, setting a reasonable additional period (at least 14 days) to make the delivery.

6. Right of withdrawal (cooling-off period) and returns

  • Customers within the EU have the right to cancel the contract within 14 days of receipt without giving any reason.
  • After notification of withdrawal, the customer has another 14 days to return the products.
  • In case of cancellation, the standard shipping costs of the outward shipment will be fully refunded if the entire order is returned.
  • Returns must be unused, unwashed, undamaged and, if possible, in their original packaging, with labels attached.
  • Return shipping costs are the responsibility of the customer, even for international orders, unless it is due to an error on our part, a defective product, or unless otherwise agreed in advance with our customer service.
  • Within 14 days of receipt and inspection of the return shipment, the purchase amount will be refunded via the same payment method, unless otherwise agreed.
  • If only part of the order is returned, only the part in question will be refunded.

7. Exceptions to the right of withdrawal

  • Products that are not suitable for return for hygienic reasons (such as underwear or lingerie) if the seal has been broken.
  • Personalized or custom-made products.
  • Digital products once delivery has started with customer consent.

8. Warranty and conformity

  • All products are covered by the statutory warranty: the product must do what the customer can reasonably expect from it.
  • If a product shows a defect within 2 years of purchase that was not caused by misuse, the customer is entitled to repair, replacement or (partial) refund.
  • The warranty is void for damage caused by improper use, inadequate maintenance, or modifications to the product.

9. Liability

  • By-Men is not liable for indirect damages such as consequential damages, lost profits or loss of data.
  • By-Men's liability is limited to the amount of the order in question, unless there is intent or gross negligence.
  • These limitations do not apply if damage is the result of intent or gross negligence on the part of By-Men.

10. Intellectual property

  • All photos, texts, designs, and other content on the website are the property of By-Men / Modelita or are used legally under license.
  • Use without written permission is prohibited and may result in legal action.

12. Applicable law

  • All agreements and disputes are exclusively governed by Dutch law.
  • Consumers within the EU retain their national consumer rights.
  • Disputes will be submitted to the competent court in the district where Modelita is established, unless the law provides otherwise.
